byShine legal India                        Published On 2025-05-31

In this digital world, the concept of signing documents has dramatically changed. Traditional physical signatures are being replaced by digital signatures. This is a secure and authorized method of confirming transactions and digital documents. It offers a quick, safe, and simple way for filling forms for the government, signing contracts, and filing tax returns.

In this article, Shine Legal India defines what a digital signature is, its numerous advantages, where it is widely utilized, and how it has legal significance in India.

What Is a Digital Signature?

An electronically encrypted seal of authenticity applied to electronic documents, communications, or software is known as a digital signature.

This is based on public key infrastructure , which employs a pair of keys:

  • Public Key: Available to all
  • Private Key: Held secret by the signer.

Names of authorized certifying authorities

  • eMudhra Limited
  • NSDL e-Governance Infrastructure Limited (now Protean eGov Technologies Limited)
  • Sify Technologies Limited
  • nCode Solutions (a division of GNFC Limited)
  • Capricorn Identity Services Pvt. Ltd.

Types of Digital Signature Certificates in India

In India, digital signatures are being provided in the form of DSC by authorized certifying authorities. The most typical classes of DSCs are

1) Individual DSC (Class-3)

An individual DSC is issued to a person for their own personal or professional use. It can be used for both signing and encryption, depending on the purpose and certificate type selected.

a. For Signing of Documents:

  • Used to digitally sign PDF files, forms, and returns submitted on portals like
  • Income Tax,
  • GST, and EPFO, etc.
  • Ensures authenticity, non-repudiation, and integrity of the signed documents.
  • Common in e-filing of returns, statutory forms, and contract agreements.

b. For Encryption of Documents:

  • Used to secure sensitive information by encrypting documents before sending them but less frequently used as compared to the signing DSC. Its usage is usually dependent on personal choices.
  • Common in industries where confidential data is exchanged, like legal, finance, and medical sectors.
  • Prevents unauthorized access to documents in transit or storage.

Note: If encryption is needed, the individual must apply for a combo DSC (signing + encryption), not just a signing-only certificate.

2) Organisational DSC

An organization DSC is given to a person allowed to speak for a business or organization, usually a director, manager, or compliance officer. It authenticates and secures official documents submitted on behalf of the organization.

a. For Signing of Documents:

  • Used for signing:

1. E-Tendering and E-Procurement Platforms as per instructions

2. CERSAI Portal

3. DGFT Portal as per instructions

  • Ensures that the submission or transaction is authorized by the company.

(b) For Encryption of Documents:

1. E-Tendering and E-Procurement Platforms as per instructions

2.DGFT Portal as per instructions

  • Encrypts sensitive data such as financial reports, bidding documents, and client records before submission or sharing.
  • Ensures data security and compliance in regulated sectors like finance, legal, and healthcare.
